Many new real estate buyers organize themselves in their search in order to be able to visit the notary around June-July: period for lease purposes.

However, your property search can take several months, it is better to start your steps and visits as soon as possible.
And the good deal or the stroke of the heart does not always warn before presenting itself and can arrive from the first weeks.
In this case, you could visit the notary well before the end of your lease.

Dilemma: How can you manage the rental costs of your current home and your mortgage payments until the end of your lease? To terminate a lease, there are several reasons in the Civil Code of Québec that allow the tenant to be able to dispose of his contract, but access to the property is not one of them. So if you find yourself in this situation, what are the different possibilities available to you? On the official website of the Government of Quebec, it is indicated that a tenant who wants to leave his dwelling but is not in a situation allowing him to cancel his lease may:

  • enter into an agreement with the lessor;
  • assignment of a Lease;
  • Subleasing.

It is important to understand that the lease is a contract that you have signed with your landlord and that you cannot assume that he should accept your decision to stop paying your rents before the end of the contract.

That’s why, the only way to get you out of this dilemma is to talk and get along with your landlord.
You can therefore make several proposals to him, which he is not obliged to accept. So be reasonable in what you propose.
This is why the choices listed below are often the ones proposed.

- Assignment of a Lease or Subleasing accommodation

You will need to find someone who would be able to continue your lease and follow all the rules.
In the case of sublease, you remain responsible for the lease.
But it is also possible to make a lease assignment and in this case, the new tenant will be responsible for the lease once he enters the premises. You will therefore be free from any responsibility from this moment on.

- Enter into an agreement

You can propose an agreement that would provide for compensation. For example, if you have 6 months left, you can propose to your landlord the payment of one or a few months during which you will no longer be in the dwelling and this absence could, for example, allowing the owner to perform refresher or other work.

Remain reasonable in order to peacefully start a new stage of voting life, that of new owner.
